on the other hand. i do think taking a persons car away permanently is kinda harsh especially if they have a loan on the car.
owing 20grand and having no way to get back the money anytime soon sucks and can **** people up for a while.

simple dont be a dumb **** in a car thats technically not yours. if u have a loan on ur car, u shouldnt be doing burnouts on a public road when u no full well ur car can be taken off you.

Its in the eyes of the cop whether it gets it towed and taken off you for 3mnths and then the second time its gone for good. That what the cop told me when i got caught doing mine about 15/16mnths ago. Can say i havent done a proper one since

They have to apply to the courts for the 3 month impound and permanent seizure, it's not automatic.

He gets his cars taken for good ($2000) and has a loan of 20grand, plus fine $2000, then court cost. Then on top of that 14 month suspension. Over a burnout...That's more punishment then drink drivers get.
It doesn't excuse the fact that he was a dumbass, but **** its, not a balanced punishment. And i think people would agree that a driver that's is blind post more danger, they are more likely to speed as well.
All we have here is populist laws and punishment, hoons are perpetrated buy the media has the biggest menace to society since child molesters or football stars.

Its wrong.. meh... im so sick of seeing this shit in the paper and all over the news... back in the day there was just as much of this going on just never in the news. I really cant comment on other peoples behaviour cause im not a saint. But the media is hyping this harder then the fuckin gangland killings.

Fair enough he lost his car. Tool for getting caught so many times.
But how legal is it for the police to seize it off him for good and sell it on him if he has a loan on it. LEGALLY you cannot sell a vehicle that is under encumbrance IIRC, because its not really your vehicle until you pay it off.
So what happens when this guy defaults on his loan? and someones brought the car from the auctions? A. The person who brought it can't change the rego details IIRC and B. The bank will take the car from who ever the new owner no question asked, because its still legally the banks.
Whats the go when it comes to novated lease vehicles or fleet vehicles, say I rip a skid in my Boss's Van 30 times and get caught? and they sell it, its not mine for them in impound in the first place.
And as for photos and videos on facebook, who said it was done on the street and it wasnt all CGI? how do the police prove that?

Well im pretty sure the police can get around those transfer laws. they probably take away the cars rego so it has to be completely re-reg'd and they give it a clean slate. then during the trial the judge (somehow, im not a lawyer) enforces that the loan is no longer to do with the car and is solely on that guy who took it out.

I don't rekon the banks will like that? That a court says "Sorry bank were teaching this bloke a lesson, taking his shizit off him, so were clearing the title on the car, and if the guy defaults on his loan you can take him to court for years trying to get the rest out of him cause you can no longer take his car"
I rekon this will cause a big shake up of the hoon laws.

point is, the car is gone. they will probs re-finance the loan to have minimum repayments if he cant make them.

most loan agreements have clauses wrtitten about jeopardising the security of the loan, id be willing to bet that the bank is now legally allowed to call in the loan... so he lost his ute, now he will get a nice letter saying he has 28 days to pay of the loan in its entirety...

but why would they try to do that? i know security is gone but he wont have the money to pay it, and as frost said they will spend sh!tloads on lawyers and court time trying to get it back.
o well im glad its him and not me in that position, although i dont think id end up in that position.

from what i heard about those hoon laws, if you have a loan on the car - they sell the car at auction and pay out the ammount to the lender, then its up to the owner to pay the rest.
thats what i heard anyway
