im posting this up for a mate..
He was at kmart plaza in burwood east, as there was a car infront of him, as the car infront took off it rolled back (manual)and bumped the front of my mates car...whos at fault? The fact that my friend didnt leave enoug room between cars, or the fact that the other driver rolled backwards? Which i belive u loose points in a test?

Both imo, but in a crowded carpark.. sometimes 'it is' difficult to keep your distance and you have to stick behind, and I admit I've often rolled backwards in a manual.. even the best do.

i dont. im not the best. but i dont. hate people that do it for ages just cruise on backwards. and i always leave huge gap to the car in front especially on stop start traffic on the highway.. it just has to be done theres too many dickheads that could come flying up behind you.. so i leave a fair few metres to creep forward once the car behind me has stopped or incase it looks like its not gonna

If your friend was not moving then it was the car in fronts' fault. Hard to get any money out of them though because all they have to do is say that they were stationary and that your friend ran into them, and most police/insurance companies will believe that rather than what actually happened.

how does the moving have anything to do with it? like at a set of lights if someone rolls back onto its your fault because you didn't leave "enough" room.

Your not allowed to travel backwards on a public road/carpark apparently.

Car in front's fault.

Back when I was 18 I rolled backwards into someone while bashing a mate. lol

I had to pay for the damages.

Hmm thats why its a bit iffy as he shouldn't have been to close (even though it was a carpark), but the fact that the guy rolled backwards (hes not ment to do that)...
Still dont know who is at fault, the guy who rolled back is saying its my mates fault ...

interesting that you had to pay that Dan, normally the car behind is at fault for not leaving enough room in front.

It isn't fucking rocket surgery.

If car 'a' is not fucking moving and car 'b' crashes into it then clearly car 'b' is to blame, regardless of the direction of travel at the time. How the **** can you be at fault in a stationary car?

Find me a legal definition that states what exactly 'enough room' is? How far can you expect to be able to blithely 'roll back' without having to worry about hitting the car behind you?

If you are reversing into a car parking bay and you hit the car behind you, are they at fault because they parked too close to the end of the parking bay?

Here’s your answer.

If it can be proven by an independent witness that the vehicle in front did in fact roll back, then the vehicle in front will be responsible, however 99% of the time the vehicle in front will say they didn’t and the vehicle behind will get done for moving forward.

Whilst you did contribute to the accident by failing to keep a safe distance, it wasn’t caused by you.

So if the front vehicle admits to rolling back, they are held at fault.
