VCAT application

Anyone had a civil dispute resolved thru vcat? I was gonna threaten these gearbox guys with a vcat application because they wont warranty the t5 but im not sure if it will get me anywhere.

on the website it says "To help settle a dispute, a mediation, directions hearing or compulsory conference may take place depending on the case; however, many cases proceed to a hearing." Even if the hearing determines they are at fault do they have to fix my gearbox under law?

btw to cut the story short. i got it back reconditioned with the same problem it had, and speaking to mechanics they say it has to b in the gearbox, took it back under warranty period, they say took too long to bring it back.

took too long? its under the warranty period, you should be able to bring it back the day before it finishes if you want. unless you signed something saying that only some types of failure are covered by a whole year.

The problem is though, if you take them to court to fix your gearbox and force them to do it, they are just gonna do a shit job aren't they. If you do take them to VCAT I would be asking that they pay for a different workshop to fix it so that you can trust the box this time.

vcat works, and what the judge says is final and has to be done, they are more likely to side with you especially if you can proove that it was taken back during warranty period, however they are more likely to get same place to fix it to try and rectify the problem, give vcat or a free solicitor a call and get some advice from them.
