You get all their details and any witnesses to the car being overloaded etc?? You shouldn't have to pay a cent for their stupidity

i've got 2 witnesses that were in my car with me, was just so pissed off i grabbed her name and wrote down her rego, spoke to the cops they said just give the insurance company the rego and they will chase it up. if they don't i will go through other methods of tracking her down, she is supposedly going to ring me today.

was leaving a Hungry Jacks Carpark, a bitch in an overloaded kia (people in the boot meaning she couldn't see out the rear window) reversed straight back into me as i was driving out. pissed off doesn't quite cover how i was feeling, i'm pretty sure the 17 year old kids or whatever in the boot thought i was going to kill them all, and had a guy been driving the kia, i would have redecorated the piece of shit with his face

looks like the car won't be getting repaired for a while, insurance is claiming because i'm under 21 i owe them $950 upfront, and because the stupid bitch hit me on private property... the best ruling i will get is a 50/50 fault judgement

over the whole thing really, car will now sit in the garage under a car cover until i can be bothered looking at it again, don't see how it's fair that i should have to pay for someone elses bloody stupidity

You should get the $950 back from insurance when the claim goes through. I fail to see why it could only be a 50/50 fault judgement. Its not rocket surgery, someone drove into your car, all by themselves, cuz they fail at driving. Do they have insurance? Get them to lodge a claim against their insurance. I had a similar situation when I got hit in the arse last year. Because we couldnt identify the 3rd person involved in the accident, my insurance wouldnt cover it. And they wanted some stupid amount upfront. I might investigate different insurance this week.

bitch refused to give me her details, hence why i took her rego, i will be going back to see the boys in blue sometime in the next couple of days to report her for the overloaded car she had and the refusal to give her details. insurance will only give me the $950 back if they can recoup it from her... which i'd say is doubtful

Just go to the police station and tell them that you want to report an accident and make a statement. Give them her rego details as part of the statement and they will contact her to make a statement too. She can't keep her details from the police. The police will decide who is at fault according to the statements of the parties involved and any witnesses if needed. Once that is done the police will give you a case number that the insurance company can look up on a database and get the details that they need.

I know this because I got rear ended while driving my first car, I tried to keep it civil and let the insurance companies handle it but the other party tried to claim that it was my fault by making a statement to the police to that effect. The police approached me for my statement and gave me the case number for my insurance company. They determined that I was not at fault and everything went through without a hitch from then on. After getting some quotes saying that it was uneconomical to repair I got a nice cheque in the mail for the market value of my car.

Yours will just get fixed since it is just a busted door of course.

You got raped man. I was reversed in to by a car next to me in a private car park while waiting for a car a few parking spots up to reverse out when I was 18 and my insurance never made me pay anything, the other person wasn't even insured. That sucks the big one.

Sucks mate.. as for not knowing which house she lives in, just put one in every letterbox in the street... sif they're gunna show one another anyhow, though living in the next street could be a bit hazardous. Could always just drive up and down the street looking for the kia... and just park outside her house and eat doughnuts.

lol the donut idea is the best. I got rear ended in my el not long after i brought it by a VE SS and i never paid a cent. My local repairer claimed half the rear end was destroyed and got himself like $600 from there insurance from a $250 job lol.

yep, was a new door either way, the intrusion protection bar in the door is bent so it's not repairable, so making the best of a shit situation, bought the new door and my uncle changed it all over while i was at work today. saved about $600 this way

Is there anything to indicate that it's not the original door? Like vin numbers or something on it?
So when it comes time if you ever need to sell it.

yes there is, sticker on the door has the wrong vin number on it, unfortunately there is nothing i can do about it, except keep the original door and if i ever sell the car show the buyer that the original door couldn't have been fixed
