They might write that off, are the chassis rails bent? At the end of the day its all upto the panel shop and the assessor. And as for buying it back you do know unless your insurance allows you to buy it back as an option, good luck bidding on it at pickles/fowles. I even offered CGU 1500 for my xr back, they said no buy it at auction, i got it for 800.

Wouldnt you be allowed to take anything you own like sterio and extra's out of the car even if it is classed as a writeoff? I dont know how these things work..

If you get to it before the assessor does, but if the wheels and stereo are listed in the insurance, then technically no.

Oh few more things Jimmy.

If your tires are bald, change them to road legal tires, if anything else on your car is illegal, like it is sitting to low or wanky neons are on the car etc, tinted taillights, take them off, insurance company's will try and do there best to get out of everything, and at the end of the day if they wipe there hands with it, you have to take her to court. But if your car was say to low, or the tires were bald, her insurance company would call you at fault.

its all good frost, thanks for the advice.

my brother works at cgu so i got all bases coverd,

car has good tyres, it is lowerd and has tint.

there is no way they can call it my fault as she colided with me, pulled infront of me at a round about.

basically she tried to turn right from a 2 lane round about, wich at this particular round about its illegal, road is ever marked straight or left and she just puled infront of me at the last second.

stereo is coming out, the insurance comapy said i can buy the car back for around 10% of the market value give or take.

No Problems.

As for being at fault not disputing that, just make sure everything is perfect, I dont know how it is in the city but out in the country CGU dont have assessors as per say, they use a company, well they use RACV, whos assessors assess vehicles on behalf of them, eg CGU, RACV few other mobs, just depends on the assessor as to if it will get fixed, if they will write it off value etc. And When you say Market Value are you going off RedBook/Glasses? I got 8500 for the XR but the glasses said 4500, I give the assessor print outs of XR6s on carsales and the prices they were for sale, so just see if your model car is worth more on there than what is listed in Red Book and Glasses.

As for buying it back at 10% of the market value so $380? let us know how you go, cause i offered CGU 20% of market value and they said I have to get it from the auctions.
