Fine for Defect?

Just wondering has anyone else here got a fine with there defect? Went out cruising last night and got pulled over by one of the task force officers from melbourne (i live 400kms from melb btw). I got a major defect for the car sitting about 50mm off the ground (couldnt even get the measuring stick under it), cambered front tires and green parker globes. Since he made it out to be major i got a $182 fine. First ive heard of it has it happened to anyone else?

well done ur first of prob many canaries to come.. i got a $182 fine for having a tail-light out! its f'ckin bullshit ay.. but yeh defects have been around for a while!

Cop it on the chin, raise it up, clear defect then lower it again.

What is the legal minimum height for ride lowering? Varies in different states, yeah?

If you're in Vic it's 100mm minimum clearance at the lowest point.

SA I think it is measured from hub to guard, and the stats vary from car to car, but I'm not form there so I could be wrong.

It's both.

335mm hub to gaurd and 100mm clearance.
Daily: EB II Fairmont, legal low. Next stereo or turbo.

approx 2 years ago i was fined $175 and a minor defect for being too low or as they called it "exceeding permited dimensions"

sucks balls but most people i know that have been defected for too low got a defect and no fine??

Ive been done for bald tyres on the bike and he said he could fine me $175 but he would rather I spent the cash on a new tyre.

I think its up to the cop if he fines you or not.

Being polite at all times can save you money :P

Yeah i just never realsied they fined you aswell. I acted on my best behaviour so have gave me the longest possible period to pay the fine but ive only got 7 days to get the defect cleared. As for heigh he measure with a full car load, 2 subs and a spare so ill pull the subs and spare out and it should make the legal limit. Theres no way in hell i will drive it without being lowered. **** that ya look like a tosser goin AFF style. Oh well ill get it payed for just means other plans are on hold

That's a damn good argument, i reckon. If a cop ever pulled me over for any minor defects, I'd just point out it'd be more worthwhile to save me the fine so I can just get it fixed quickly. Probably also try and make out like I had no idea about it (especially with lowered cars). Anyone else tried this?

Cops are just random, I dont know how many times ive seen cops, either driving or at booze busses etc. and ive never been pulled up due to my ride height, which is prob only 50mm off the ground, got the jack out today to get under the car and the jack was a good inch and a half too big to fit under my car!

LOL, it's only too low if you can't fit a compressed scissor jack under the sills and have to use the towbar as a jacking point 8-)

Agreed on cops being random, they seem to just make shit up on the spot. I got pulled up on the Eastern freeway once for speeding (127kmh) and ended up with two fines. One for speeding obviously and another for bald rear tyres was around $500 all up, the TMU that pulled me up also mentioned the rear of my car was too low and to 'sort that out', he also failed to notice I had AU1 XR wheels on with adapters :lol: . I think the only reason I didn't get a defect was because we were in the emergency lane and it was too dangerous to check things out properly. That and he probably couldn't have been fucked doing it.

Another time taking off from a set of lights next to a VN lol, I dumped the clutch and took off with the arse out then wondered why the VN wasn't having a go. I guess he must have seen the motorbike cop sitting in my blind spot. :evil: The cop was ok though and didn't put any points on the fine even though he should have, just fined me for 'fail to maintain control of the Vehicle' or some crap. I had perfect control of the old EA. :P

I know of people that have been defected for 'too many handbrake clicks' and no water in the washer jets lol

Every cops different and every shift is different, i know fines are at the discretion of the officer for minor defects but i dont know whether this is the case for majors as well.

Well rear suspension is back to standard. I must admit its so comfy but my god its so damn ugly. Gettin the R/W tomorrow morning so it will be low again 2morro night thank god. I feel like a wanker driving a 4wd that has the handling abilitys of a boat

It must be a P plater thing. Since ive been off my P's, ive been waved through every booze bus and havent been pulled over or even a second look at the car. 19's + Superlows. My brother on the other hand, his is a tiny bit lower than mine on the same wheels but a P plater, he gets hasselled all the time.

the fine is for driving an un-roadworthy vehicle. The last one I got was $165 so they must have put it up....inflation sux lol.

althought p plates dont help. it is not just that.
for over a year on my p plates i have never been stopped at a booze bus. in my lowered ed on supers. and in a bright green ba xr6.
never been pulled over. (unless you count when i was doing skids down a dirt road and then speeding and a cop spotted me and talked to me when i was pulled over allready :P)

sure they are not huge attention seeking cars but the way i drive constantly gets enough attention :D

i've been lucky, 8 times pulled up while i was on my P's and 8 warnings!!!

worst one was on a beastclub cruise with full tank, subs, and 4 ppl in the car (the two in the back had a combined weight of 248kg!!!). he said i had a different horn compared it to his car :D he said it was too low and i said "NO WAY!! got it done last week and said to them to make it legal...", it was done bout a year earlier. measured it later at 55mm... he said "well i'll grab the wheel then". we both walked to his car, he opened the back, wheel in the middle of the boot and he said "damn i cant find it, guess you got lucky didnt you" and smiled and told me to enjoy the cruise!!!!!!! nicest cop ever, knew we werent causing trouble and let me go...

my mate got pulled up by him 2wks later and he was in a bad mood, mate got defected for low, loud, and HANDBRAKE PAST 4 CLICKS!!! when he went to vicroads to clear it the guy looked at the defect and laughed...

i got done for a major canary and i didnt get any fine just anova pretty yellow sticker got done at Noble maccas 2 weeks after all dat riot crap happned, i was just there 2 get some food 4 me n 2 mates
it was for
- Rims to big
- Gas wasnt checked (but it was checked)
- To low
- Reflective surfaces chrome wipers and chome gauge on pilar
Had 2 get roady, change exhaustwell just rear put anova muffler on,EPA test with guttered cat lol didnt change it, took gas off, used my parents wheels from the ef xr8, changed all green globes parkers and numberplate lights, was just a hassle and a bit of $$$

Use unsafe vehicle is the fine.

Discretion is used at all times, so be on your best behavior.

P plates have nothing to do with it.

Remember that some coppers are not car nuts, even if they are, they are mostly Holden nuts. Wouldn't know the first thing about a Ford. We are not mechanics (although some used to be).

The major minor thing re a fine that someone mentioned. The fine is always up to the copper. If it is a major defect, then the car should be grounded straight away. A minor defect is dependent on the defect. Example: If it is pouring with rain and your wipers don't work, immediate grounding. If it is a hot summer's day, then 7 days.

The maximum is 7 days. It is either 7 days or immediate grounding, there should not be any in between.

End of line.
