Advice - Clearing a defect - Queensland..

Hi All,

While sitting at a set of traffic lights a couple of weeks ago I had a policeman do a U turn (illegal U turn mind you :P) and pull in behind me.. He followed me for 8k's and pulled me over in the driveway of the Police station. He mentioned that my car was too loud and asked how long I have had the exhaust on, i replied "5 years". He told me he was going to issue me a defect notice, and I would have to do and get the car tested at QLD transport and bring back proof that the car was not too noisy, I had no problems with this as despite driving a modified car I am a law abiding citizen..

He issues me with a defect notice, and off I went.. I got home and re read the Notice and become confused... Pics Below..

So on part of the notice that I cropped, it says "Inspection Type: Certificate", and it says I need to Produce the Vehicle for a full Certificate of Inspection.. And then a comment that it requires testing to establish DB..

Question:
Am I taking the car to someone to get a RWC, and then to Queensland Transport to get the exhaust tested? Or is the QLD inspection station going to do a full inspection on the car, AND test the exhaust?
Or are they Simply just going to test the exhaust for noise, and off I go?

I am after responses from people who know the PROCESS OF CLEARING A DEFECT in QUEENSLAND, not people in other states, or who's mates dogs cousin knew a guy who did this...

I'm sure the DB test is part of a safety cert anyway? But its been a while since I done a RWC in QLD so I guess I fall into the "people in other states, or who's mates dogs cousin knew a guy who did this..." group

you have to fix the exhaust (quieten it down) and produce it to the Deception Bay Police Station, just get a tin plate out of 2mm gall drill a few holes into it and trim to fint in at th cat/exhausst flange so that it quietens it down, make sure its still able to run/drive you dont want to restrict it too much. then take it to the D'bay police station, then they will clear it.

Ihave done this before to clear a minor defect, then remove when you get home, will cost you more for the new 2 gaskets then it will for the stell plate.

Hrmm, thanks for the reply, that does sounds pretty easy.

But i am still unsure as to why the box is ticked "Produce the vehicle for a full certificate of inspection" etc box is ticked... I can only take 1 day off work to get all of this sorted out, so need to be sure that it's all I need!

I have only recently moved northside and everyone has warned me about how bad the cops are here, thinking I might get a couple of mufflers put on to quieten her down, I am too old to spend my time screwing around with defects! Apparently northside cops don't appreciate the sweet sound of a 347 :P

Call the member who issued you the ticket and ask him. He will have his copy still and be able to clear any issues you've got.

Yeah thats the plan, all of this came about as I was organizing someone friday arvo to get my RWC and he thought the car may need to go over the pits, rather then a RWC. So all weekend I have been pondering how badly they may try and rape me for stupid shit if I went over the pits.

Technically you don't have to do anything as the officer has fucked up the defect notice.

He has put a cross in the boxes when it clearly says you have to attend to any items that have been ticked, and he has just stated that the vehicle must be noise tested, not that it has to comply with any maximum noise emissions requirements in legislation.

In your place i wouldn't do anything. You may eventually get a letter in the mail saying you might get a ticket if you don't comply with the defect notice. If you then eventually do actually get a ticket in the mail for 'failing to comply with a defect notice' (or if the officer is super keen and issues you one at your house) just accept it and elect to go to court. Don't tell him anything, just take the ticket and say thanks mate, and wait about 20 days before filling out the back of the ticket as an election to go to court.

Once you go to court plead not guilty, you'll get a court date set. Go again and state that you did not comply with a defect notice because there was nothing to comply with - note the crosses and the statement that the vehicle requires testing. State that the notice actually doesn't tell you to do anything so you didn't do anything about it.

If the cop can't be stuffed writing a proper notice make him go to court, it's a lot more work for a cop to go to court than it is for you.
